This Acceptable Use Policy ("AUP") governs the use of valtrogen's encrypted network transport services. By using our Services, you agree to comply with this AUP. Violations may result in suspension or termination of service.
1. Introduction
This AUP is incorporated by reference into our Terms of Service. Read this AUP together with our Privacy Policy. If you do not agree, discontinue use of our Services immediately.
valtrogen provides encrypted network transport services designed to protect the confidentiality of your communications in transit. While we provide tools for privacy protection, users remain responsible for their conduct and compliance with applicable laws.
2. Intended Use
valtrogen's encrypted network transport services are designed for legitimate security and privacy needs. Understanding the intended use helps ensure our services remain available for lawful purposes.
2.1 Approved Use Cases
The Services are designed and intended for the following legitimate purposes:
- Public Wi-Fi Protection: Securing sensitive data and communications when using public or untrusted networks;
- Remote Work Security: Providing secure connections for distributed teams, remote employees, and contractors;
- Enterprise Communications: Protecting confidential business communications and internal data;
- Cross-Border Data Transfer: Facilitating secure international data transmission in compliance with data protection regulations;
- Industry Compliance: Meeting security requirements for regulated industries (healthcare, finance, legal, etc.);
- Personal Privacy: Protecting individual communications from unauthorized surveillance or interception;
- Developer & Testing: Secure sandbox environments for development and testing purposes;
- Research & Academic: Legitimate security research and academic studies conducted in compliance with applicable laws and ethical guidelines.
2.2 Services Are NOT Designed For
The following uses are expressly outside the intended scope of our Services:
- Circumventing copyright protection or digital rights management;
- Accessing illegal content or materials;
- Concealing criminal activity or evading law enforcement;
- Bypassing legitimate network access controls or security measures;
- Evading legal obligations, court orders, or regulatory requirements;
- Engaging in activities that would be illegal without encryption;
- Facilitating fraud, identity theft, or financial crimes;
- Any purpose that violates applicable laws or regulations.
2.3 Not a Shield for Illegal Activity
Important: valtrogen's encryption services protect the confidentiality of legitimate communications. They are not designed to—and do not—provide protection from legal consequences for illegal activities. Using encrypted services does not make illegal activities legal, nor does it prevent law enforcement from investigating criminal conduct through other means.
3. Prohibited Activities
The following activities are strictly prohibited:
3.1 Illegal Activities
- Any activity that violates applicable laws, statutes, or regulations;
- Distribution of child sexual abuse material (CSAM);
- Unauthorized access to computer systems, networks, or data;
- Intellectual property infringement, including unauthorized distribution of copyrighted material;
- Fraud, identity theft, or financial crimes;
- Drug trafficking or sales of controlled substances;
- Human trafficking or exploitation;
- Terrorism or support for terrorist organizations;
- Money laundering or sanctions evasion.
3.2 Network Abuse
- Distributed denial-of-service (DDoS) attacks or network flooding;
- Unauthorized security scans or vulnerability testing;
- Distribution of malware, viruses, or malicious code;
- Interference with other users' services;
- Port scanning or network reconnaissance without authorization;
- Exploitation of security vulnerabilities;
- Bandwidth abuse or resource exhaustion attacks.
3.3 Harmful Content
- Spam, unsolicited bulk messages, or chain letters;
- Phishing sites or fraudulent schemes;
- Content promoting violence, discrimination, or harassment;
- Hate speech targeting protected characteristics;
- Defamatory or libelous content;
- Threats, intimidation, or stalking;
- Non-consensual intimate imagery.
3.4 Service Abuse
- Circumventing service limitations or quotas;
- Sharing accounts or credentials in violation of subscription terms;
- Reselling or redistributing the Services without authorization;
- Automated access or scraping without permission;
- Interfering with service infrastructure or other users.
4. Geographic Restrictions
Due to regulatory requirements, export controls, international sanctions, and local laws governing encrypted communications services, access to our Services from or within the following countries and territories is subject to additional restrictions:
- Belarus
- China
- Iran
- Iraq
- Kazakhstan
- North Korea (DPRK)
- Pakistan
- Russia
- Syria
- Turkey
- Turkmenistan
4.1 Conditions for Use
If you are located in, or a resident of, any of the above countries or territories, you may only use the Services if you meet all of the following conditions:
- Your use is expressly permitted under applicable local laws and regulations;
- You have obtained any required governmental licenses, permits, or authorizations;
- Your use does not violate any applicable international sanctions, export controls, or other restrictions;
- You have a legitimate and lawful purpose for using the Services.
4.2 Your Responsibility
You are solely responsible for determining whether your use of the Services is lawful in your jurisdiction. valtrogen does not provide legal advice and makes no representation that the Services are appropriate or available for use in any particular location. By accessing the Services from a restricted territory, you represent that you have verified the legality of such use and assume full responsibility for compliance with all applicable laws.
4.3 Enforcement
We reserve the right to restrict, suspend, or terminate access to the Services from any location at any time, without prior notice, to comply with applicable laws, sanctions, or regulatory requirements. Use of technical means to circumvent geographic restrictions without legitimate legal authorization is prohibited and may result in immediate termination without refund.
This list may be updated at any time. We encourage users in restricted territories to regularly review this policy and consult with legal counsel regarding their specific circumstances.
5. User Responsibility & Liability
5.1 Your Legal Responsibility
valtrogen provides only an encrypted transport channel—we do not control, monitor, or review the content transmitted by users. You bear full legal responsibility for all activities conducted through the Services, including:
- All content you transmit, receive, or access;
- All actions taken using your account;
- Compliance with all applicable laws in your jurisdiction;
- Any consequences arising from your use of the Services.
5.2 Encryption Does Not Equal Immunity
Important: Using encryption services does not exempt you from the obligation to comply with applicable laws. You should understand that:
- Encryption protects data confidentiality—it does not make illegal activities legal;
- Law enforcement can investigate crimes through means other than intercepting encrypted traffic;
- Account information may be disclosed in response to valid legal process;
- You remain fully liable for your conduct regardless of whether communications are encrypted;
- valtrogen will cooperate with lawful investigations as described in Section 9.
5.3 No Reliance
You should not rely on valtrogen's Services as a means to evade legal consequences for unlawful activities. The Services are a tool for protecting legitimate communications, not for circumventing the law.
6. Security Requirements
Users are responsible for:
- Maintaining security of their devices and accounts;
- Using strong, unique passwords and enabling two-factor authentication;
- Keeping software and operating systems updated;
- Protecting account credentials from unauthorized access;
- Reporting security incidents to [email protected];
- Cooperating with security investigations;
- Not sharing account credentials or access with unauthorized parties.
7. Resource Usage
Fair usage requirements:
- Bandwidth: Stay within allocated limits. Excessive usage may result in throttling or additional charges.
- Connections: Do not exceed the concurrent connection limits specified in your plan.
- Fair Use: Adhere to the fair use policy in your service agreement. We reserve the right to limit service if usage exceeds reasonable levels.
- No Abuse: Do not use the Services in a manner that degrades performance for other users.
8. Compliance Requirements
8.1 Legal Compliance
Users must comply with:
- Data Protection: GDPR and applicable data protection laws when processing personal data through the Services;
- Export Controls: EU export control regulations and applicable sanctions; do not use Services for prohibited activities;
- Local Laws: Ensure your use complies with laws in your jurisdiction;
- EU Regulations: All applicable EU laws and regulations.
8.2 Industry Compliance
If you use the Services for business purposes in a regulated industry, you are responsible for ensuring your use complies with applicable industry regulations (such as HIPAA, PCI-DSS, SOX, or financial services regulations). valtrogen provides transport-layer security and does not certify or guarantee compliance with specific industry standards—you must implement additional measures as required by your regulatory obligations.
8.3 Organizational Policies
If you access the Services through an employer or organization, you must also comply with that organization's acceptable use policies and IT security requirements. valtrogen is not responsible for conflicts between this AUP and your organization's policies.
9. Enforcement & Cooperation
9.1 Our Rights
valtrogen reserves the right to:
- Investigate suspected violations of this AUP;
- Suspend or terminate services without notice for violations;
- Remove or disable access to content that violates this AUP;
- Report illegal activities to appropriate authorities;
- Take appropriate legal action against violators.
9.2 Law Enforcement Cooperation
valtrogen may cooperate with law enforcement agencies in the following circumstances:
- Valid Legal Process: We will respond to valid court orders, warrants, subpoenas, and other legal process in accordance with applicable law;
- Scope of Disclosure: Due to our no-traffic-logging policy, we can only provide account information (registration details, payment records, connection metadata) and cannot provide traffic content;
- User Notification: Where legally permitted, we will notify affected users of legal requests;
- Emergency Situations: We may disclose information without legal process where we believe in good faith that there is an imminent threat to life or serious physical harm;
- No Voluntary Surveillance: We do not proactively monitor user activity or voluntarily provide user information to any government agency without legal compulsion.
9.3 Internal Investigations
When investigating potential AUP violations, we may:
- Review account information and metadata;
- Analyze usage patterns for signs of abuse;
- Request information from you regarding suspected violations;
- Temporarily suspend access pending investigation.
We do not inspect the content of user traffic as part of routine enforcement.
10. Reporting Violations
Report violations to [email protected]. To help us investigate effectively, please include:
- Detailed description of the alleged violation;
- IP addresses and timestamps (if available);
- Supporting evidence (screenshots, logs, etc.);
- Your contact information for follow-up.
We will investigate all credible reports and take appropriate action. Anonymous reports are accepted but may limit our ability to follow up.
11. Consequences of Violations
Violations of this AUP may result in one or more of the following actions:
11.1 Warning
First-time or minor violations may receive a warning with instructions to remedy the violation. Continued violations after a warning will result in more severe consequences.
11.2 Suspension
We may temporarily suspend your access to the Services while we investigate a potential violation, or until you remedy a violation. Fees continue to accrue during suspension unless otherwise determined by valtrogen.
11.3 Termination
Severe or repeated violations will result in permanent account termination without refund. Grounds for immediate termination include:
- Any use involving serious crimes (CSAM, terrorism, etc.);
- Network attacks or security breaches;
- Repeated violations after warnings;
- Fraudulent account activity;
- Any use that exposes valtrogen to legal liability.
11.4 Legal Action
For serious violations, valtrogen may:
- Report activities to law enforcement;
- Pursue civil remedies for damages;
- Cooperate with third-party legal actions;
- Seek injunctive relief to prevent ongoing harm.
12. Policy Updates
We may update this AUP to reflect changes in our Services, legal requirements, or best practices. When we make material changes:
- We will post the updated AUP on our website;
- We will update the "Last Updated" date;
- For significant changes, we will notify registered users by email;
- We will provide at least 14 days' notice before changes take effect, except where immediate changes are required for legal compliance or security.
Your continued use of the Services after the effective date of any changes constitutes your acceptance of the updated AUP. If you do not agree to the changes, you must stop using the Services before the changes take effect.
